Marcthom Trading Pty Ltd, trading as Thomas and Hurley, its affiliates and subsidiaries, collectively referred to in this policy as “T&H”, “we”, “our” or “us” sells furniture and homewares and associated products both from store locations and online. As part of our business we collect your personal information and tell you how we use, store or distribute that information.

We respect and uphold your rights to privacy under the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) ("Privacy Act") in relation to the collection, management and disclosure of your Personal Information.

By using this website or providing us with your personal information, you agree to, and consent to the collection, use, holding and disclosure of personal information by T&H as set out in this policy.

Personal information we may collect from you includes, without limitation your:

  • contact details such as your name, telephone, residential, mailing and email addresses;
  • date of birth, age, purchase history, income, occupation, hobbies and interests;
  • details of the products and services you have purchased from us or which you have enquired about, together with any additional information necessary to deliver those products and services and to respond to your enquiries;

We take all reasonable steps to ensure the accuracy of information we hold. You can contact us to request the correction of any inaccurate information we hold about you.

What do we do with your personal information?

In addition to any purpose notified to you at the time of collection we use your personal information for the purpose for which it has been provided, for reasonably related secondary purposes and for the purpose of:

These communications may be sent in various forms, including mail, SMS, social media, fax and email, in accordance with applicable marketing laws.

We take reasonable steps to protect any personal information that we hold from misuse, interference and loss and from unauthorised access, alteration and disclosure but we cannot guarantee the security of your personal information. You must also take reasonable care to protect your personal information (for example, by protecting any usernames and passwords). You should notify us as soon as possible if you become aware of any security breaches.

Opting Out / Unsubscribe

We only want to communicate with you if you want to hear from us. If you have received any promotional material and do not wish to receive any more, please let us know and we will respect your request. At any time you may opt out of receiving marketing communications you have previously subscribed to. Unless you opt out, your consent to receive direct marketing communications from us and to the handling of your personal information as detailed above, will continue. If you would like to be removed from all marketing communications you can use the unsubscribe button where provided or at any time by emailing OPT OUT to [email protected].

If you choose to opt out or unsubscribe, this does not automatically unsubscribe you from marketing communications from other brands.

Cookies & IP Addresses

Some of the information we collect from you may be anonymous (such as logging your IP addresses (the electronic address of a computer connected to the internet) to analyse trends, administer our website, evaluate the effectiveness of our online advertising, track users’ movements, and gather broad demographic information. Third parties may be used to collect such statistical data. No Personal Information is collected on these occasions.

We may use "cookies" to help personalise your online experience, track which pages you visit and save you time across partnered websites. T&H websites

When transmitting personal information from your computer to a T&H website or a website operated by one of our third party partners, you must keep in mind that the transmission of information over the Internet is not always completely secure or error-free. Other than liability that cannot lawfully be excluded, we will not be liable in any way in relation to any breach of security or any unintended loss or disclosure of that information.

Some T&H websites are operated and maintained by third parties to whom we have partnered with to provide you with their products and services, or otherwise may link to third party websites. These websites will be subject to the website terms and conditions of the third-party who operates the website, and any interactions or transactions you conduct on these websites will be between you and the third-party partner. You may request access to your personal information that we hold about you, or seek correction of it, by contacting us in writing.
